Conservation Commission
   Meeting

        October 21, 2010

Peg Arguimbau Chairman, Hank Langstroth, Keevin Geller, Meredith deCarbonnel, Stephen Cremer, and Elizabeth McGrath were the members present. The Conservation Administrator, Greg Meister, was also present.

8:00 p.m., A Notice of Intent Public Hearing filed by Stony Brook Court for the proposed
repaving work at 51 Hixson Farm Rd. DEP File #SE-280-0519:

Mike Carter, Representative from G.C.G. Associates, Inc., appeared before the Commission
to represent the Applicant. He submitted the green abutter cards and a proposed plan
entitled, “Hixson Farm Road Development Pavement Rehabilitation, Sheet Numbers 1 through 4,
Town of Sharon, MA,” dated 9/30/10.
It was the consensus of the Commission to waive the Local By-law fee following their review of the proposed plan submitted by the Applicant.
Peg called for a motion for the Commission to waive the Local By-law fee as a courtesy to the Hixson Farm Housing Authority from the Town of Sharon.
Keevin Geller moved. Elizabeth McGrath seconded. Voted. Unanimous 6-0-0.
The Conservation Administrator visited the proposed site and approved the wetland lines flagged by Wetlands and Land Management, Inc., in July 2010.
Mike Carter explained to the Commission that the size of the proposed parcel is 12 ± acres. A small vegetated wetland is located to the south of the existing building on the site. A small pond is located to the south of the entrance driveway on the site. Wetland Flag Numbers A-1 through A-8 are located along the edge of a bank resource area. Wetland Flag Numbers A-9 through A-41 are located along the Bordering Vegetated Wetland areas of the site. The 100’ Buffer Zone is outlined in red on Sheet #2 of the submitted plan and is delineated at the wetland boundary and bank resource area of the site. The proposed disturbance to the 100’ Buffer Zone on the site is approximately 28,000 sf. There is an existing detention basin located in the southwest corner of the proposed project site. The grass area surrounding one side of the detention basin is maintained by the Hixson Farm Housing Authority. The other side of  the detention basin is wooded.
Mike Carter explained the following scope of the proposed project to the Commission:
  • The proposed project is to reclaim and repave the existing entrance driveway, parking lots, curbing, and associated sidewalks without increasing the impervious areas of the project site.
  • The contractor for the proposed project plans to reclaim the pavement by using a roto tiller to pulverize the pavement and then mix in the material with the existing gravel. Any remaining excavated material will be removed from the proposed project site.
  • The proposed repaving material consists of a 2 ½” binder course and a 1 ½” top coat of asphalt.     
Stephen Cremer inquired if there is any indication that the existing drainage system endangers the
viability of the pond or the wetland resource areas of the site.
Mike Carter explained that all of the existing drainage structures have been inspected and are functioning properly. He said that the existing drainage system and vegetated wetlands areas of the site will not be disturbed from the proposed project.
Meredith deCarbonnel suggested that the Applicant install outlet hoods on all of the existing catch basins to control any excess stormwater runoff, to the maximum extent possible, especially along the pond area.
The members of the Commission requested that the Applicant install a water quality structure along the pond area to protect the viability of the pond and the wetland resource areas of the proposed project site.
Mike Carter agreed to submit a modified plan to address the concerns of the Commission.
Peg called for a motion to close the hearing and to issue the Order of Conditions to the Applicant pending receipt of a revised plan showing details of the water quality structure and outlet hoods on all of the existing catch basins.

8:15 p.m., A Notice of Intent Public Hearing filed by DKW Builders for a proposal to install
supplemental drainage along the frontage of Lot 1, 129 Bullard Street, DEP File # SE-280-0520:

Rick Merrikin, an Engineer from Merrikin Engineering, appeared before the Commission to represent the Applicant. He submitted the following proposed plans to the Commission:
  • “Proposed Sewage Disposal System, Lot 1 Bullard St., Sharon, MA.” 10/5/10, Last Date Revised.
  • “Lot 1 Bullard St., Detail Plan Of Land In Sharon, MA.” 10/5/10, Last Date Revised.
Rick Merrikin explained to the Commission that the proposed installation of a supplemental
drainage system along the frontage of  Lot 1, 129 Bullard Street, will improve the stormwater runoff
flow within the gutter of the roadway. The Conservation Administrator visited the proposed site and approved the delineated wetland lines flagged by Applied Ecological Sciences on June 18, 2010. The proposed drainage system installation lies within the 100’ Buffer Zone of a Bordering Vegetated Wetland.  
Rick explained to the Commission that the Town Engineer inspected the proposed project site and requested that the Applicant improve the drainage facilities along the frontage of Lot 1, Bullard Street, for the proposed development of a single-family home. The Applicant has agreed to comply with the Town Engineer’s request to install a drainage swale along Bullard Street.  The excess stormwater currently flows along the gutter of the roadway, across the street into an neighboring driveway, discharges into a nearby wetland, and then flows through a culvert pipe on Town property before emptying into large adjacent wetland area Rick explained the following scope of the proposed project to the Commission:
  • The installation of a gravel swale within a four bay basin along the gutter on the west side of Bullard Street.
  •   The installation of a culvert pipe beneath Bullard Street.
  •  The installation of a stone filled trench on the west side of Bullard Street as an outlet structure.  
(The excess stormwater flow will eventually discharge into the existing Bordering Vegetated Wetland on the east side of Bullard Street.)
  • The installation of siltfence/haybales along the limit of work area for erosion control during construction of the proposed project.
The members of the Commission requested that the Applicant contact the Conservation Administrator before starting the proposed project for inspection of erosion control measures.
The Commission agreed to approve the Applicant’s proposed project per submitted plan.
Peg called for a motion to close the hearing and to issue the Order of Conditions to the Applicant per submitted proposed plan.

8:30 p.m., Old/New Business:

-The Sharon Housing Partnership:
The Commission reviewed an e-mail from the Housing Partnership regarding a potential buildable parcel on Town Owned land. The potential parcel is located at 26 Oak Hill Drive. Their intent is to potentially build 2 -story, 3 bedroom homes, on one acre lots. The Sharon Housing Partnership is requesting the Commission’s assistance in flagging the wetlands on the parcel.
The members of the Commission requested that the Conservation Administrator research the deed and flag the wetlands on the site upon verification of a buildable lot.

-Cedar Swamp Project:
The members of the Commission reviewed and approved the bid request prepared by Franz Ingelfinger, Representative from the Commonwealth of Massachusetts Division of Ecological Restoration, regarding a ground survey of groundwater monitoring wells and critical locations within the Cedar Swamp.

- Enforcement Order concerning the violation at 144 Brook Road:
The members of the Commission agreed that the Conservation Administrator would contact Town Counsel concerning Michael Moreshead’s violation at 144 Brook Road.

The attending Commission members reviewed and signed the following documents regarding the proposed Massapoag Sportsmen’s Club land swap:
  • Memorandum of Agreement by and between Mass Audubon and the Conservation Commission for land off Belcher Street that is associated with the Massapoag Sportsmen’s Club Land Swap.
  •    Quitclaim Deed with Conservation Restrictions to the Massapoag Sportsmen’s Club for land off Belcher Street from the Town of Sharon.
  •   Quitclaim Deed to the Town Of Sharon from the Massapoag Sportsmen’s Club concerning four parcels of land totaling 34.96± acres.
  • Conservation Restriction to the Town Of Sharon and Mass Audubon for land off Belcher Street from the Massapoag Sportsmen’s Club.
